Terms & Conditions

This Met Card Member mobile application (“the Application”) is owned by London Clubs International Limited trading as Metropolitan Gaming.
In these terms and conditions “we” means Metropolitan Gaming and “you” refers to a client who accesses or uses the Application. These terms and conditions are supplementary to the general terms and conditions of The Met Card.

1.1 Use of the application is free in terms of any monetary fee. However, by using the Application, you agree to be bound by these Terms and Conditions.

1.2 We reserve the right to amend these Terms and Conditions at any time. If you disagree with any of these Terms and Conditions, you must immediately discontinue your access to the Application and your use of the Services offered by it. Continued use of the Application will constitute acceptance of these Terms and Conditions, as amended from time to time. Notification of any such changes will be sent to you via a push notification through the Application.

1.3 Your use of the Application may be prevented or rescinded by Metropolitan Gaming in its sole discretion at any time.

2.1 In these Terms of Use, the following terms shall have the following meanings, except where the context otherwise requires:

a. “Account” means an account created by a User on the Application on completion of Registration and for access and use of the application.

  • “Application” - the Met Card Mobile Application
  • “Metropolitan Gaming” -the trading name of London Clubs International Limited a company registered in England.
  • “Data Processing Notice” means the Data Processing Notice set out on the website of Metropolitan Gaming as amended from time to time.
  • “Purchases” means your purchase of offered items using your Met Points and “Purchase” means all or any one of them.
  • “Registration” means the act of creating an Account.
  • “Services” means all the services provided by Metropolitan Gaming to users via the Application and “Service” means any one of the services provided through the application.
  • “Users” means users of the Application, including you.
  • “We” means Metropolitan Gaming.
  • “You” means you as a user or users who access or use the application.

3.1 Your Account is for your own personal use only. It is not for business or wider commercial use.

3.2. You must be and warrant that you are at least 18 years old.

3.3. You must not set up an Account if you have enrolled in SENSE (the national Self-exclusion scheme for Gaming) or if you are excluded from any Casino owned or operated by Metropolitan Gaming. In setting up an account you are warranting that you are not so excluded.

3.4 You warrant that all information provided on Registration and contained as part of your Account is true, complete and accurate and that you will promptly inform us of any changes to such information by updating the information in your Account.

3.5 You must not share your Account with any other party for any purposes. If you become aware that access to your Account has been compromised you must notify us as soon as possible on appsupport@metropolitangaming.com

3.6 It is your responsibility to ensure that you have permission to use any mobile phone or device used to access your Account or the Application or to submit any images or words.

3.7 You are responsible for arranging and paying for any telecommunications or internet connectivity needed to access your Account or the Application. Metropolitan Gaming do not provide telephonic or internet connectivity.

3.8 You are responsible for ensuring that you are able to access your Account and the Application legally in whatever jurisdiction you choose to access them and to ensure that you are not in breach of any contract from your mobile provider or any internet service provider.

4.1 You undertake not to use or permit anyone else to use the Services or the Application to send or receive any material which is:

  • illegal in any relevant jurisdiction, defamatory, offensive or in breach of confidence, any court order, copyright, or any other third party’s rights or in respect of which you do not have relevant permissions, licences or authority.
  • technically harmful and/or modifies the Application of our systems in any way (including but not limited to unduly burdening our IT systems with unnecessarily high loads, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or corrupting data).
  • for a purpose other than which we have designed them or intended them to be used.
  • for any fraudulent purpose including purporting to be any third party other than you.
  • other than in conformance with accepted Internet practices.

4.2 You agree also not to or permit anyone else to:

  • Resell or share any data, vouchers or personal information displayed within the Application.
  • Provide false information including false names, addresses and contact details.
  • Attempt to circumvent our security or network including to access information not intended for you, log into a server or account you are not expressly authorised to access or probe the security of other networks.
  • To capture data not intended for you.
  • Restrict or inhibit any other user from using or enjoying the Application or Services.

5.1 We will use reasonable endeavours to correct any errors or omissions as soon as practicable after being notified of them. However, we do not guarantee that the Services or the Application will be free of faults, and we do not accept liability for any such faults, errors or omissions.

5.2 Whilst we will try to allow uninterrupted access to the Services and the Application, access to the Services and the Application may be suspended, restricted or terminated at any time. We do not warrant that your use of the Services or the Application will be uninterrupted whether by force majeure, power outage or otherwise. Moreover, your access to the Application and the Services may also occasionally be interrupted for upgrades, maintenance or the introduction of new Terms and Conditions, facilities or Services. In all cases, we will attempt to restore such access as soon as we reasonably can.

5.3 We do not warrant that:

  • any information (or messages) transmitted via the Services or the Application will be transmitted accurately, reliably, in a timely manner or at all.
  • The Services and the Application are free from viruses or anything else which may have a harmful effect on any technology.

5.4 For the avoidance of doubt, we reserve the right to withdraw any information or Services from the Mobile Application at any time at our sole discretion.

5.5 We reserve the right to block access to and/or to edit or remove any material which in our reasonable opinion may give rise to a breach of these Terms and Conditions.

6.1 If you use (or anyone other than you, with your permission uses) the Application, any Services in contravention of these Terms and Conditions, we may suspend or rescind your use of the Services and/or the Application.

6.2 If we suspend the Services or the Application, we may refuse to restore the Services or the Application for your use until we receive an assurance from you, in a form we deem acceptable, that there will be no further breach of the provisions of these Terms of Use.

6.3 Metropolitan Gaming will co-operate with any law enforcement authorities, court order or relevant regulator requesting or directing Metropolitan Gaming to disclose information relation to the Application.

Our rights under these Terms and Conditions shall not prejudice any other right or remedy we may have in respect of any breach or any rights, obligations or liabilities accrued prior to termination.

7.1 The Application, the Services, the information on the Mobile Application and use of all related facilities are provided on an “as available” basis without any warranties whether express or implied.

7.2 To the fullest extent permitted by applicable law, we disclaim all representations and warranties relating to the Application and its contents, including in relation to any inaccuracies or omissions in the Application, warranties of merchantability, quality, fitness for a particular purpose, accuracy, availability, non-infringement or implied warranties from course of dealing or usage of trade.

7.3 We shall not be liable for any acts or omissions of any third parties howsoever caused, and for any direct, indirect, incidental, special, consequential or punitive damages, howsoever caused, resulting from or in connection with the mobile application and the services offered in the mobile application, your access to, use of or inability to use the mobile application or the services offered in the mobile application, reliance on or downloading from the mobile application and/or services, or any delays, inaccuracies in the information or in its transmission including but not limited to damages for loss of business or profits, use, data or other intangible, even if we have been advised of the possibility of such damages.

7.4 We shall not be liable in contract, tort (including negligence or breach of statutory duty) or otherwise howsoever and whatever the cause thereof, for any indirect, consequential, collateral, special or incidental loss or damage suffered or incurred by you in connection with the Application and these Terms and Conditions.

7.5 For the purposes of these Terms and Conditions, indirect or consequential loss or damage includes, without limitation, loss of revenue, profits, anticipated savings or business, loss of data or goodwill, loss of use or value of any equipment including software, claims of third parties, and all associated and incidental costs and expenses.

7.6 The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer that cannot be excluded or limited are affected.

7.7 Notwithstanding our efforts to ensure that our system is secure, you acknowledge that all electronic data transfers are potentially susceptible to interception by others. We cannot, and do not, warrant that data transfers pursuant to the Application, or electronic mail transmitted to and from us, will not be monitored or read by others.

8.1 You agree to:

  • Indemnify and keep us indemnified against any claim, action, suit or proceeding brought or threatened to be brought against us which is caused by or arising out of your use of the Application or Services or any other party’s use employing your email address, password and/or any identifier number allocated by Metropolitan Gaming.
  • Pay us damages, costs and interest in connection with such claim, action, suit or proceeding.

9.1 All information, opinions, sounds, photographs, illustrations, artwork and other graphic materials, and names, logos and trademarks on the Application are protected by law and belong to us and/or our suppliers, as the case may be. These may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted or circulated whether in whole or in part, unless expressly permitted by us and/or our suppliers, as the case may be.

9.2 Nothing contained on the Application grants any license or right to use any trademark displayed on the Application without our written permission. Misuse of any trademarks or any other content displayed on the Application is prohibited. We reserve the right to take legal action against any unauthorised usage of our trademarks, or contents of the Application to protect our rights. All our rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be the trademarks of their respective owners.

The Application can be accessed from numerous countries around the world where the local technology permits. As each of these places have differing laws, by accessing the Application you agree that:

  • the laws of England will apply to all matters relating to the Application; and
  • to submit to the exclusive jurisdiction of the courts of England in respect of any dispute arising out of and/or in connection with the Application and these Terms of Use.

Access to the Application and use of the Services offered by Metropolitan is subject to our Data Processing Notice set out on our website. By accessing the Application and by continuing to use the Services offered, you are deemed to have accepted our Data Processing Notice, and in particular, you are deemed to have consented to our use and disclosure of your personal information in the manner prescribed in this Data Processing Notice. We reserve the right to amend this Data Processing Notice from time to time.

We are committed to creating a culture of Safer Gambling within our casinos. We have appointed Safer Gambling Ambassadors across all our sites, in order to protect young and vulnerable people from being exploited by gambling, prevent underage gambling and increase support for the treatment of gambling harm.
